Terms of Service

1. Acceptance of Terms

By accessing or using PeakListings (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a brokerage, company, or other entity, you represent that you have authority to bind that entity to these terms.

2. Description of Service

PeakListings is an AI agent platform for real estate that provides MLS integration, deal management, market intelligence, and workflow automation tools for real estate professionals. The Service includes web-based software, APIs, and related support.

3. Account Terms

• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• One person or entity may not maintain more than one account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of fair housing laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers
• Reproduce, duplicate, or resell any portion of the Service without express written permission
• Use the Service to generate content that violates fair housing regulations, discriminates against protected classes, or misrepresents property information
• Scrape, data-mine, or extract data from the Service beyond your authorized use

5. MLS Data & Compliance

You are responsible for complying with your MLS board’s rules and data sharing agreements. PeakListings processes MLS data on your behalf as authorized by your MLS feed connection. You must ensure that your use of MLS data through PeakListings complies with all applicable MLS rules, IDX policies, and RESO standards.

6. AI-Generated Content

PeakListings provides AI-generated content including listing descriptions, market analyses, and email drafts. You are responsible for reviewing all AI-generated content before use. AI output may contain errors or inaccuracies. PeakListings does not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

You retain ownership of content you create using the Service. By using AI features, you grant PeakListings a limited license to process your data as necessary to provide the Service.

7. Payment & Billing

Paid plans are billed monthly or annually as selected. AI usage costs are billed at actual provider cost with no markup, calculated and invoiced monthly. All fees are non-refundable except as required by law. We may change pricing with 30 days’ notice.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by PeakListings and protected by copyright, trademark, and other intellectual property laws. Your data remains yours. We claim no ownership over the content you upload or create using the Service.

9. Limitation of Liability

To the maximum extent permitted by law, PeakListings shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these terms or if required by law. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.

11. Governing Law

These terms are governed by the laws of the State of Montana, United States, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved in the state or federal courts located in Montana.

12. Changes to Terms

We may modify these terms at any time. We will provide notice of material changes at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified terms.
